Terms and Conditions

Thank you for taking an interest in booking your photoshoot with Victoria Louise Photo Studio , please read these terms and conditions carefully. Should you decide to use my services, I will ask you to confirm notice of my terms and conditions in writing. I will be happy to answer any questions or concerns you may have in relation to these T&Cs at any time.

As referred to as photographer meaning Victoria Louise Fenix of Victoria Louise Photo Studio.

Photographs:

* No editing of Victoria Louise Photo Studio images is permitted; this includes filters from Instagram and other social media. Altering images in any way is strictly forbidden and action will be taken against anyone who breaks these terms.

* Downloading, printing and screenshots of any preview images are not permitted and strictly prohibited. This includes cropping out the signature watermark and uploading images onto your social media without prior agreement with the photographer, any client found doing this may be subject to prosecution.

* The entire copyright in the photographs is retained by Victoria Louise Fenix of Victoria Louise Photo Studio at all times. When you perchance digital images the photographer is giving the rights for only printing for your personal home use.

* Photographs taken during the course of the session will be at the discretion of the photographer, although every effort will be made to comply with the clients requirements.

* The photographer reserves the right to refuse to supply, or grant a reproduction license to a third party when requested to do so by the client. The right to use the pictures only within the clients home, no commercial use is authorized unless agreed upon by the photographer. 

* On agreement to processing your data, all your details are held confidentially, your data will not be made available to outside companies or individuals in compliance to GDPR. Should you wish to have your data removed from the database, please request in writing to retain your rights and read the privacy policy (below) for more information.

* The photographer takes pride in their business and commitment to privacy, so please be assured that no images will ever be passed to any third parties and will only ever be used by the photographer considerately and decently.

* Your images will be stored on a hard drive for approximately six years; you can come back to the photographer within that time to order any other prints or products. After six years of your photoshoot your images will be permanently deleted. If you wish for your gallery of images to be deleted once you have made your print order and not stored on the hard drive, please ask for this in writing and the photographer will gladly permanently delete your gallery on request.

Payments:

* A deposit payment must be paid prior to the photo shoot to secure your photoshoot date and time, this is a non-refundable retainer fee. The photographer will not double book you and the experience will be devoted to you as a client.

* Payment can be made online via PayPal, bacs, or make an appointment to visit the studio to have a consultation and pay in cash or on card.

* Payment plans are available; your images/products will be ordered once a deposit of £10 is placed. You will then receive your prints/products once you have fully completed your payment plan.

* Where extra expenses or time have occurred from the original brief from the client to the photographer, the client is to give the approval in writing and is liable for the additional costs occurred to the photographer.

* There is no min spend at Victoria Louise Photo Studio.

* Additional costs: All pricing is clearly outlined on the pricing documents. Should you wish for additional advanced editing on your photographs you will be charged accordingly for this. If you would like your images to be posted to you, there will be postal costs dependent on the size of the package; this will be discussed at time of ordering your prints/products. Travel costs may apply dependent on your location of your photoshoot, all information and pricing for this will be discussed with the client prior to the photoshoot. There should be no other additional or hidden costs, than outlined.

Studio policies:

* During mini photoshoots, if you arrive more than 5-10 minutes late to your session you will only have the remainder of the time to be photographed. “Mini shoot days” are held with photoshoots planned back to back, so please plan for your photoshoot and arrive on time, allow for traffic and parking.

* Children must be supervised at all times, the photographer cannot take responsibility for children that do not settle and refuse to co-operate to have their photo taken. 

* Any damages to the studio or equipment owned by the photographer made by the client must be paid by the client. 

* The client agrees that they are responsible for all parties involved within the agreed photoshoot with Victoria Louise Photo Studio. The client agrees to assume responsibility for any liability for any individual in their party. 

* Failure to attend your photoshoot: You will not receive a refund, or your deposit will not be returned to you.

Prints & Products:

* The sizes of prints and canvases within the price list are estimate only and may be over or under the quoted nominal size due to all products being individually hand-made and sourced by professional printing companies accessible only to professional photographers.

* Please be mindful that there is a crop ratio on images taken at high resolution when printing, so some images may be cropped off, all effort will be made to crop negative space or feet should this occur. Should a photograph not fit in a chosen print size, the nearest one will be chosen and the client will be notified of this.

* All photographs supplied by Victoria Louise Photo Studio are produced to the highest standards using the best quality materials and latest processing techniques. However, all photographs will, in time, fade. This is particularly true if they are left in bright sunlight and are not behind glass. Victoria Louise Photo Studio cannot accept any responsibility for this gradual image deterioration.

* All digital images are set to the format needed for the printing lab the photographer uses, in which the photographer cannot guarantee that when self-fulfilling your own prints from the digital images that they will be the same quality and color as they would be from the professional printing lab. This is due to the calibration and printing equipment used by different suppliers.

* Should digital files be lost, damaged or destroyed the photographer’s liability shall be limited to replacement of CD/USB only in the given year of the photoshoot, but shall not include a refund for any goods already supplied. The photographer must be notified either by your communication method or by email and confirm in writing within three working days of the client(s) being in receipt of their order in the case of error, shortage or damage as mistakes cannot be rectified after this period. Please back up your digital images.

* All services and/or goods are supplied at the current prices ruling at the time of supply, and are subject to change without prior notice, although all effort will be made to communicate with the client.

* Complaints: Any must be received in writing within seven days of the receipt of products purchased. This includes photographs, discs, albums, frames and any other special services that have been agreed.

*Change of Date: If you need to change the date of the photo services then any new date will be subject to the photographer's availability. The photographer shall use reasonable endeavors to arrange an alternative date for the photos services. Failure to arrive at your photo-shoot without prior notice results in forfeit of the photographer’s time and deposit paid. Please contact the photographer within 12 hours of your planned photoshoot should your child be ill to reschedule your photoshoot experience.

* Cancellations: In the event of Cancelation from the photographer due to circumstances that is beyond their control (Injury, accident, illness) all attempts will be made for another photographer to stand in (Events) or the photoshoot to be rescheduled. In the unlikely event of complete photography failure the client is liable for a full refund.

If you need to cancel your photoshoot due to illness or a family emergency, you may no less than 12 hours prior to your photoshoot. Having children of my own, I know that sometimes life is not linear and this is why my cancelation period is much shorter than the average 24 hours. Please note if you have not contacted me to cancel your photoshoot, you maybe refused to reschedule your appointment.

* Compliance: should your child refuse to participate in having their image taken and therefore very few images taken without happy pictures, no refund will be given, all effort will be made to offer a reshoot if necessary for full portrait shoots but is not granted for mini shoots.

The photographer reserves the right to amend these terms and conditions without prior notice.

Website Privacy Policy

This privacy policy notice is supplied by Victoria Louise Photo Studio and oversees the privacy of those who use the following website. The purpose of this policy is to explain to you how I process and protect your personal information, including your rights under current laws and regulations. If you do not agree to the following policy you may wish to cease using this website.

Under GDPR a photograph is classed as someone’s personal data, therefore consent is needed to be given for Victoria Louise Photo Studio to use their clients images on their portfolio (Website, Facebook, Instagram and studio samples) Consent is done via the booking stage and again verbally after the photoshoot has been taken place. Clients can request for their images to be taken down from Victoria Louise Photo Studio social media portfolios prior to agreeing on sharing their images and the photographer, Victoria will remove portfolio images on request. If the client wishes for their photographs to be permanently deleted from the photographers hard drive, Victoria Louise Photo Studio will comply and delete their data (Photographs)

PROCESSING OF YOUR PERSONAL DATA:
Under the GDPR (General Data Protection Regulation) I process any personal information about you electronically using the following laws. 

The reason I use this as everyone should have the right to privacy and I, therefore, respect my client's consent.
* I process your information in the following ways: digitally on my laptop and on paper for my records. 
* Data holding period: I will continue to process your information until you withdraw consent or it is determined your consent is no longer relevant. 
* Sharing your information: I do not share your information with third parties. 

* I ensure the security of any personal information held by using secure data storage technologies meeting the GDPR compliance requirement.

If the way I process your personal information changes, I will notify you about the change and any new lawful basis to be used if required. 

YOUR INDIVIDUAL RIGHTS:
Under the GDPR your rights are as follows. You can read more about your rights in details here;

* the right to be informed, have access, any data processing, and the right not to be subject to automated decision-making including profiling.

You also have the right to complain to the ICO [www.ico.org.uk] if you feel there is a problem with the way I am handling your data.

I handle subject access requests in accordance with the GDPR.

I use cookies on this website to provide you with better user experience. This is done by placing a small text file on your smartphone/computer hard drive to track how you use the website, to record and to display relevant adverts referred you to a third party website. Some cookies are required to enjoy and use the full functionality of this website. I use a cookie control system which allows you to accept the use of cookies and control which cookies are saved to your smartphone/computer. Some cookies will be saved for specific time periods, where others may last indefinitely. EMAIL SUBSCRIPTIONS:
Under the GDPR I use the lawful consent for anyone subscribing to my newsletter/marketing mailing list. I only collect certain data about you as detailed "Processing of your personal date" above. Any email marketing messages I send are done so through an email marketing service provider. An EMS is a third party service provider of software that allows business to send out email marketing campaigns to a list of users. These email marketing messages that I send may contain tracking clickable links or similar server technologies in order to track subscriber activity within email marketing messages, which records a range of data such as; times, dates, opens, clicks, forwards and demographic data, such data will show the activity each subscriber made for that email campaign.

Complaints &Refunds Procedure

Firstly please read through the terms and conditions as it may answer and questions or matters you wish to raise.

To lodge an complaint please contact Victoria via email (victoria@victorialouisephoto.uk) or by using the inquiries form on the contact page of the website (www.victorialouisephoto.uk) so that it is done in writing.

Please contact me with any matters within 72 hours of your services or receiving your photos.

If you feel that your photos are not to standard after a detailed discussion with me, you may contact the photography association that I am with for advice and support; this is the society of Wedding and portrait photographers. Under the consumer rights act: supply of good and services act (1st Oct 2015) Your photographs by law should be supplied with reasonable skill and care, and if they are deemed as not you may be able to claim a partial or full refund.

Should all your images be lost due to equipment failure you should be liable for a full refund. Before contacting the small claims court, you must have lodged a complaint in writing with your photographer with endeavours to resolve the matter first.


Confidentiality

All information past between client and Victoria is to remain confidential at all times, unless for a cause for concern, and then Victoria will contact the relevant legal professionals such as police or social services.

If an employee breaks the rule of confidentiality, a stern warning is due- Victoria will issue staff only three warnings, before being dismissed; unless the client’s safety has been breached and therefore will be dismissed immediately from employment with Victoria Louise Photo Studio due to miss conduct. Victoria will enforce confidentiality with her staff at the beginning of the contract and at regular intervals to keep up-to-date and follow safeguarding protocols.

Victoria wishes for her clients to feel at ease within her practice and have a safe space to be able to open up and relax at the studio, therefore some personal information maybe shared.

Victoria has undergone safeguarding training in her prior profession before becoming a photographer and well as having a DBS check and have some knowledge of handling personal matters, but is not qualified.
